Statements of ReasonsStatements of reasons are usually produced by the Board when a party to the proceedings makes a request for written reasons. All requests must be received in writing within 28 days of the hearing, with Statement of Reason's produced within 14 days thereafter. The statement of reason will set out findings of fact and the evidence on which such findings were based, and the reasons for the decisions arrived at on the basis of such findings. The statement of reason is not a transcript of the hearing. It is important that the Board be publicly accountable and that its decisions should, as far as practicable, be transparent. This is particularly so given that all hearings are held in private because of the sensitive nature of the evidence presented to the Board. To this end, a selection of recent statements published by the Board are available on this site. It should be noted that, consistent with the Mental Health Act 1986 secrecy provisions, parties to a hearing are "de indentified" in any subsequent statement of reason.
